A conference to mark the retirement of Professor Alan Boyle as Chair of Public International Law at the University of Edinburgh School of Law
The sources of law are at the foundation of any legal system, playing a vital role in identifying legal rules and distinguishing them from other types of social or moral obligation. For most international lawyers, Article 38(1) of the ICJ Statute provides the starting point for any discussion on the sources of international law. Yet, despite being the bedrock for the sources of international law for almost a century, the invitingly simple language of this provision conceals as many uncertainties about the sources of international law as it resolves. Innovations in law-making in the twenty-first century have further contributed to blurring of the boundaries between the sources of law, as well as challenging the boundaries of law itself. The purpose of this conference is to reflect upon the current state of the debate on the sources of international law as a matter of both theory and practice, taking into account recent judicial decisions and scholarly work in this area. Contributions will discuss both general international law, as well as specialized fields of international law, all of which share a common root in the sources of international law.
